Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Ispeedhost’s websites, dashboards, APIs, and hosting/infrastructure services (collectively, the “Services”). Ispeedhost is headquartered in Raleigh, North Carolina (USA).
By accessing or using the Services, you agree to these Terms. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization, and “you” refers to that organization.
1. Definitions
- “Ispeedhost,” “we,” “us,” “our” refers to Ispeedhost and its affiliates.
- “You,” “your” refers to the individual or entity using the Services.
- “Customer Content” means any data, files, text, images, software, or other content you upload, store, transmit, or process using the Services.
- “Service” may include compute (including accelerated/GPU options), virtual servers, web hosting, object storage, networking, and related tools.
2. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Services. You may not use the Services if you are barred from doing so under applicable law.
3. Account Registration and Security
You may need an account to access the Services. You agree to:
- Provide accurate, current information and keep it updated.
- Maintain the confidentiality of your credentials and access keys.
- Promptly notify us of unauthorized access or suspected security incidents.
You are responsible for all activity under your account, including actions taken via API keys or team members you authorize.
4. Our Services
We provide infrastructure and hosting capabilities, which may include:
- Provisioning and managing instances and related resources
- Storing and serving content through object storage
- Support, monitoring, usage tracking, and billing features
Service availability and performance may vary, and the Services may change over time. We may add, modify, or discontinue features. Where practicable, we will provide reasonable notice of material changes.
5. Acceptable Use Policy
You agree not to use the Services to:
- Violate any applicable law or regulation
- Infringe intellectual property or other rights
- Distribute malware, exploit systems, or conduct unauthorized scanning/attacks
- Operate botnets, phishing, spam campaigns, or fraudulent activity
- Host or transmit content that is illegal, abusive, or harmful (including child sexual abuse material)
- Mine cryptocurrency or run resource-abusive workloads unless explicitly permitted by your plan or written authorization
- Interfere with or disrupt the Services, networks, or other customers
- Circumvent usage limits, security controls, or access restrictions
We may suspend or terminate your access for violations, suspected abuse, or to protect the Services and other customers.
6. Customer Content and Responsibilities
You retain ownership of Customer Content. You are solely responsible for:
- The legality, accuracy, and quality of Customer Content
- Configuring your services securely (including access controls, firewalls, patching, and key management)
- Maintaining backups, unless your plan explicitly includes backup services
You grant Ispeedhost a limited, non-exclusive right to host, copy, transmit, and process Customer Content only as necessary to provide and secure the Services and to comply with lawful requests.
7. Intellectual Property
The Services, including software, interfaces, logos, and documentation, are owned by Ispeedhost or its licensors and are protected by intellectual property laws. Except as expressly permitted, you may not copy, modify, reverse engineer, or redistribute the Services.
You may provide feedback or suggestions. If you do, you grant us the right to use it without restriction or compensation.
8. Third-Party Services
The Services may integrate with or link to third-party services. We are not responsible for third-party services, and your use of them is governed by their terms and policies.
9. Fees, Billing, and Taxes
If you purchase paid Services, you agree to pay all applicable fees and taxes. Depending on the service type, billing may be subscription-based, usage-based, or both.
Key points:
- Usage-based charges may accrue in real time based on your consumption.
- If payment fails or your balance is insufficient, we may suspend, throttle, or terminate services to prevent further charges.
- Taxes (VAT/GST/sales tax) may be added where required.
All fees are non-refundable except where required by law or explicitly stated in writing.
10. Suspension and Termination
A. By you
You may stop using the Services at any time. Certain data may remain for a limited period as described in our Privacy Policy and retention practices.
B. By Ispeedhost
We may suspend or terminate access:
- For violations of these Terms or suspected abuse
- To protect the security and integrity of the Services
- To comply with legal requirements
- For non-payment
Where reasonable, we will attempt to provide notice and an opportunity to correct issues.
11. Service Levels and Maintenance
We strive to provide reliable services, but we do not guarantee uninterrupted availability. Planned maintenance, upgrades, emergency patches, and events outside our control may cause downtime or service degradation.
Any service-level commitments must be stated in a separate written agreement (if applicable).
12. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” ISPEEDHOST DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
You acknowledge that hosting and internet-based services carry inherent risks, and you are responsible for appropriate security measures.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- ISPEEDHOST WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST DATA, OR BUSINESS INTERRUPTION.
- ISPEEDHOST’S TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED THE AMOUNTS PAID BY YOU TO ISPEEDHOST FOR THE SERVICES GIVING RISE TO THE CLAIM DURING THE THREE (3) MONTHS BEFORE THE EVENT FIRST GIVING RISE TO LIABILITY.
Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
14. Indemnification
You agree to defend, indemnify, and hold harmless Ispeedhost and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising from:
- Your Customer Content
- Your use of the Services
- Your violation of these Terms or applicable law
15. Export Controls and Sanctions
You agree to comply with applicable export control laws and sanctions regulations. You may not use the Services if you are located in a restricted jurisdiction or are a prohibited party under applicable law.
16. Privacy
Our Privacy Policy explains how we collect and use information. By using the Services, you agree to our Privacy Policy.
17. Changes to These Terms
We may update these Terms from time to time. The “Effective date” above indicates when they were last updated. If changes are material, we will post them on this page and may provide additional notice through the Services. Continued use after changes become effective means you accept the updated Terms.
18. Governing Law and Venue
These Terms are governed by the laws of the State of North Carolina, without regard to conflict of law principles.
Unless prohibited by applicable law, you agree that any dispute arising from these Terms or the Services will be brought in the state or federal courts located in or near Wake County, North Carolina, and you consent to personal jurisdiction there.
